How To Read The Lis Pendens ReportIn New York, Lis Pendens are filed
because a payment has not been made on a mortgage for
at least 3 consecutive months or on property taxes for one year. Once
the Lis Pendens is filed, the mortgage or property taxes are considered
to be in default and the property is in the beginning stages of foreclosure.
Profiles Publications, Inc.’s weekly Lis Pendens Reports provide
vital information regarding these mortgages and tax liens and the properties
they are filed against. Defendant: The person who took out the mortgage and who has not paid the plaintiff for 3 consecutive months. For tax liens, this is the property’s owner. Property: Address of the property against which the mortgage or tax lien is held. Mortgage Date & Amt: The month and year when the mortgage was taken out and the original principal amount of the mortgage loan. For tax liens it is the date as of which the property taxes are owed. Filing Type: M = Mortgage default filing. T = Tax lien filing. Index #: The index number of the file where all the papers relating to the ongoing foreclosure action are filed. Block & Lot: The indexing system used by the City of New York to identify each property. B/C: Building Classification Code: The letter and number combination code assigned by the City of New York to describe and classify each property. Plaintiff's Attorney and Telephone Number: This is the attorney that filed the foreclosure action on the Plaintiff. |
